1. General conditions
The General Terms and Conditions have been compiled in accordance with the applicable regulations of the Republic of Croatia, in accordance with the Consumer Protection Act and international conditions for e-business. The online store simbioza.hr (hereinafter: "online store") is operated by Simbioza j.d.o.o., an e-business service provider (hereinafter: "Merchant").

By registering in the online store, the visitor receives a username and a user password chosen by the user. The username and password are associated with the entered data. By registering, the visitor guarantees that he is an adult and that he has full legal capacity. By registering, the visitor becomes a user and gets the right to purchase. By purchasing, the user becomes a customer.
Anyone may at any time in writing or through any other communication channel request that the personal data controller permanently or temporarily discontinue the use of personal data.
These General Terms and Conditions define the operation of the online store, the rights and obligations of visitors, users and customers, and the business relationship between the Merchant and the user and customer of products from the online store offer.
Product information and other content simbioza.hr are for informational and educational purposes and can advise you without obligation on our part. Our responsibility for the use of products and information does not exist.
2. Access to information
The trader undertakes to make available to the user:
- information on the identity of the company (name and place of business, register number),
- contact details, which enable the user to communicate quickly and efficiently with the Merchant (e-mail address, telephone,);
- information on the essential characteristics of the product, ie the services from the web store offers.

- method and conditions of product delivery;
- information on the method of payment;
- product return information;
- information on the procedure for user complaints
3. Product offer, delivery time and product download
Due to the nature of online business, the offer of products on the website is often changed and updated. This can lead to errors. Please inform us about them via e-mail email@example.com or call us at 091 3260 003 . We will try to solve the problem as soon as possible.
Promotions and discounts
If the products on the website are already on sale, that is, they have a defined discount, additional discounts on these products are not valid. In such an example, the system will offer the customer a discount that will be more favorable for him. When using a discount coupon, it is also possible to use only one coupon (code).
We deliver the ordered products by our own delivery or renowned delivery services (Croatian Post, HP Express, DPD and others).
The deadline for delivery to the territory of the Republic of Croatia is usually six working days, except for those shipments that are delivered to the islands (the specified deadline in this case can be extended by a maximum of two more days).
The deadline for delivery for the territory of EU countries is 10 working days, except in special cases, when this is not possible for any reason of difficult delivery.
Delivery deadlines do not include: the day of receipt of the order, the time of delay due to incorrect and incomplete address of the recipient, the time of delay due to some force majeure or traffic jam for which Symbiosis j.d.o.o. cannot bear responsibility, Saturdays and Sundays, and public holidays.
Due to the possible impossibility of delivery, we reserve the right to refuse orders for some countries in the world.
The online price is valid for all users of the Merchant's online store.
All prices on the online store are stated in HRK and EUR and include VAT, unless explicitly stated otherwise. Prices do not include shipping costs. Prices are valid only for electronic ordering of products through the online store.
Prices are valid at the time of filling out the purchase order and have a predetermined value. Prices are valid in case of payment by the above payment methods under the conditions above. Despite efforts to update accurate data, price information may be inaccurate. In this case, or in the event that the price has changed during the processing of the order, the Merchant will:
- inform the user (buyer) about the new prices. In this case, the user (buyer) has the opportunity to change his order, partially or completely cancel it, or confirm the order at new prices, all without additional costs: that is,
- to enable the user (buyer) to cancel the purchase and at the same time offer him a solution that will be to the mutual benefit and satisfaction.
5. Purchase procedure
When the order is received, it goes through the processing process. The merchant receives a notification via email that the order has been received.
6. Child safety
The retailer in the online store does not take orders from persons he knows or suspects are children and persons under 18 years of age. The retailer does not offer access to products that are harmful to children in the online store.
A merchant will not store any personal information from children or third parties without the written permission of a parent or guardian unless it is obtained from a parent or guardian.
Any communication with children will be appropriate to their age and will not take advantage of their trust and lack of experience.

All mediated information is protected from third party access, which ensures you a worry-free and uninterrupted business with the service provider.
Protecting your personal information means:
- We will never misuse your personal information in any way.
- We will never give your contact and personal information to any third party.
- Your contact and personal information may only be disclosed to a third party with your permission.
Collection and processing of personal data
The Merchant collects personal data of Customers only to the extent necessary to fulfill its obligation, to inform about new and promotional products and delivery of promotional materials, to improve relations with Customers and to check other data necessary for online shopping.
What data do we collect?
Symbiosis j.d.o.o. for business purposes, it collects the following personal data: name and surname, address and place of residence, e-mail address, contact telephone number, password in encrypted form and other data that the user enters in the forms on the simbioza.hr website. Symbiosis j.d.o.o. is not responsible for the accuracy of the data entered by the user.
To ensure security and provability, the IP addresses from which users access the website are also collected. At the beginning of the visit, an individual user is assigned a session cookie to identify and track the shopping cart. Symbiosis j.d.o.o. may store other cookies on the user's computer, such as the user identification number in encrypted form (to identify the user on the next visit) and Google Analytics cookies (website traffic analysis).
Session cookies are stored in server memory only during visiting duration and are deleted after one hour of inactivity, while permanent cookies are stored on users computer for 2 years, after that they become inactive.
Who do we share your information with?
Symbiosis j.d.o.o. undertakes to protect the personal data of the Buyers in accordance with the Personal Data Protection Act and undertakes not to disclose the personal data to third parties in any way without the consent of the Buyer. (except for the data necessary for business partners to perform the delivery of the purchased product). Exceptions to this are cases in which the Seller, by a valid order of the authorized state bodies, in accordance with the law, is obliged to submit or allow access to the personal data of the Buyers.
Symbiosis j.d.o.o. does not record your credit card number or store transaction information. Symbiosis j.d.o.o. uses a third-party, authorized bank, to encrypt your credit card, which encrypts your data.
Replenishment and deletion of personal data
The customer has the right to request the addition, correction or modification of incorrect personal data. Also, the Buyer / User has the right to request the deletion of personal data at any time (right to forget). The customer can do so by requesting the e-mail address of the personal data protection officer firstname.lastname@example.org and the data will be deleted without delay. The user has the option of submitting a request for deletion in each notification received from simbioza.hr via e-mail, or can send an e-mail to the e-mail address of the personal data protection officer email@example.com stating that his personal data is deleted.
When visitors write a comment on a web page we collect the information displayed in the form of a comment, and also the IP address of the visitor as well as the string of the browser’s user agent to more easily detect spam.
If you upload an image to a web page, you should avoid uploading images that have embedded location data (EXIF GPS). Website visitors can download them and extract any location information from images on the website.
We keep the data from the contact form for 1 year due to customer service, but we do not use the data sent through the contact form for marketing purposes.
Freedom of choice
You control the information you provide about yourself. If you choose not to provide any of the information to your service provider, then you will not be able to access certain sites or features of the website.
Users who want to unsubscribe from simbioza.hr e-news, and are not able to do so themselves by clicking unsubscribe, to contact us by e-mail firstname.lastname@example.org. If you have changed your personal data (postal address, e-mail address, physical address, telephone number), please inform us about the changes by e-mail email@example.com
Automatic recording of information (non-personal information)
Whenever you access the website, general, non-personal data (user browser, number of visits, average time of visits to the pages, pages visited) is recorded automatically (not as part of the application). We use this information to measure the attractiveness of our website and to improve its content and usability. Your information is not subject to further consideration and is not disclosed to third parties.
Add-ons for social networks
Symbiosis j.d.o.o. uses so-called social media plugins (“buttons”) such as Facebook, Instagram and Twitter.
When you visit the website, these buttons are deactivated by default, for example, they will not send any data to the appropriate social networks if you do not select it yourself. To be able to use these buttons, you must activate them by clicking on them. They are active until you deactivate them again or delete your cookies.
Cookies are inconspicuous documents that are temporarily stored on your hard drive and allow our site to recognize your computer the next time you visit us on the website.
According to EU regulations, Symbiosis j.d.o.o. must store the user's consent before storing a cookie.

How long we keep your data
If you write a comment, the comment and its metadata are saved forever. This is so that we can automatically recognize and approve future comments, instead of keeping them waiting for approval.
For users who register on our website, we also store the personal information they provide in their user profiles. All users can view, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also view and edit this information.
We keep contact form entries for six months, analytics records for one year, and sales records for customers for five years.
What rights do you have over your data
If you have an account on this website, or have written comments, you may request to receive an export file of the personal information we hold about you, including any information you have provided to us. You may also request the deletion of any personal information we hold about you. This does not include any information we are required to keep for administrative, legal or security purposes.

How we protect your data

Simbioza.hr takes data protection seriously and takes various precautions to protect personal data. Unfortunately, no data transmission over the Internet, or any wireless network, can be 100% secure. As a consequence, although Symbiosis j.d.o.o. implements reasonable data protection safeguards cannot guarantee the protection of any information transmitted to or from the simbioza.hr website and is not responsible for the actions of any third party that receives such information. Simbioza.hr stores personal data with service providers within the EU.
What procedures do we have prepared in case of data breaches
In the event of a data breach, potential or actual, we send notifications to users via email, such as an internal notification system, contact mechanisms, or rewards for finding code errors.
The server hosting this website is adequately protected.
8. User opinion and product reviews
Opinions, comments and product ratings provided by users or visitors are part of the functionality of the online store and are intended for the user community.
- The trader is not responsible for the content of opinions, comments and product ratings provided by users or visitors. The Merchant's opinions, comments and ratings prior to the publication of the review and reject those that are obvious untruths, that are offensive, mislead other visitors and users, obscene or in the opinion of the Merchant do not offer any benefit. The trader is not responsible for the information in the comments and ratings and disclaims any liability arising from that information.
- By publishing opinions, comments or ratings, the user or visitor allows the Merchant to use or publish all or part of the work in all electronic or other media without time or any other restriction, if they are in the business interest of the Merchant. This includes posting on ads or other types of communications. The author of opinions, comments or ratings guarantees that he is the owner of the material and moral copyrights for the written opinions, comments and ratings and that he leaves them to the Merchant free of charge and indefinitely.
The merchant strives to ensure the up-to-dateness and accuracy of the information published on its website. Nevertheless, product features, delivery times, or prices may change so quickly that the supplier fails to correct the information on the Internet in a timely manner. In this case, the customer will be notified of the changes and will allow him to cancel the purchase or replace the ordered product.
Although the supplier strives to provide accurate images of the items sold, all photographs taken are symbolic. Photos do not guarantee the properties of the product. From the moment of sending the shipment of the ordered products to the courier, the trader is not responsible for damage, destruction, loss, lack of contents in the shipment and opening of the shipment. In the above examples, the user (buyer) must contact the supplier and start the complaint procedure. The trader, together with the courier, will do everything possible to resolve the complaint as soon as possible.
10. Complaints and disputes
The trader has an established complaint handling system. The user (buyer) can call us on the phone number +385 91 3260 003 or can contact the e-mail address email@example.com.
- The trader is aware of the basic feature of a consumer dispute, as far as litigation is concerned, and its asymmetry between the economic value of the claim and the costs incurred in resolving the dispute. The trader is looking for the best way to resolve any disagreements peacefully.
- All possible disputes are resolved through Croatian substantive and procedural law, in the court in Zagreb. All relations and rights that are not covered by these general terms and conditions are regulated by the Law on Obligations, the Law on Electronic Market Business and the Law on Consumer Protection.
11. Changes in general business conditions
In the event of a change in the General Terms and Conditions governing the operation of the online store, data security and other areas related to the operation of the online store, and in the event of a change in the General Terms and Conditions, the Merchant will inform users and visitors on simbioza.hr. All changes take effect upon the expiration of the eight-day period from the publication of the changes or amendments. If the change is necessary for compliance with regulations and laws, it may become valid in the short term.
A user who does not agree with the changes or amendments must cancel his registration within 8 days because after 8 days this is no longer possible. The user can cancel the registration by sending a written statement of cancellation to the merchant.
